Please read these TermsPlease read these Terms carefully before using the XCOGNiSAAS AI Funnel Engine. By creating an account, accessing, or using any part of the platform, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Definitions

  • "Company", "we", "us" — Fabeminds Counselling Private Limited, operating as XCOGNiSAAS.
  • "Platform" — The XCOGNiSAAS AI Funnel Engine at xcognisaas.com and related subdomains.
  • "Service" — All features, tools, APIs, and AI-generated outputs on the Platform.
  • "User", "you" — Any individual or entity accessing or using the Platform.
  • "Credits" — Consumable units required to generate AI-powered funnel assets.
  • "BYOK" — "Bring Your Own Key": using your own AI provider API key.

2. Eligibility

You must be at least 18 years old and legally capable of entering contracts under Indian law. By registering, you confirm you meet these requirements and, if acting for a business, that you have authority to bind it.

3. Account Registration & Security

You agree to provide accurate information, maintain password security, not share credentials, and notify us immediately at support@xcognisaas.com of any unauthorized access. We may suspend accounts used fraudulently or in violation of these Terms.

4. Platform Services & Credits

4.1 AI Funnel Generation

The Platform uses large language models to generate marketing assets. All generated content is algorithmic and may require human review before publication.

4.2 Credits System

  • Credits are consumed on generation. The estimated cost is shown before you proceed.
  • Subscription credits do not roll over between billing periods unless explicitly stated.
  • Top-up credits (one-time) do not expire and are used after subscription credits.
  • Credits have no cash value and are non-transferable.

4.3 BYOK

If you use your own AI API key, you are responsible for its costs and compliance with the provider's terms. See our Privacy Policy for how we handle your key.

5. Subscription Plans & Billing

5.1 Plans & Pricing

We offer Free, Starter, and Scale tiers (with optional BYOK and one-time Funnel passes). Pricing is shown on the pricing page and may change with 14 days' notice.

5.2 Payment Processing

Payments are processed by Razorpay (PCI-DSS compliant). By paying, you agree to Razorpay's Terms. We do not store your full card details.

5.3 Taxes

The price shown at checkout is the price you pay.

5.4 Auto-Renewal

Subscriptions auto-renew each period. You may cancel from billing settings at any time; cancellation takes effect at the end of the current paid period.

6. Refunds & Cancellations

See our full Refund & Cancellation Policy. Summary:

  • Subscriptions: Refundable within 7 days if no credits consumed.
  • Top-up credit packs: Non-refundable once credits are added.
  • First Funnel Offer (₹199): Non-refundable.

7. Acceptable Use

You must not use the Platform to generate illegal, fraudulent, or defamatory content; infringe third-party IP; reverse-engineer the platform; use bots; resell access; or violate the Information Technology Act, 2000 or any other applicable law. Violations may result in immediate account suspension without refund.

8. Intellectual Property

The Platform's software, design, and trademarks are owned by Fabeminds Counselling Private Limited. You retain your inputs; you receive a licence to use AI-generated outputs for your own business. We do not claim ownership of your outputs. You are responsible for ensuring outputs do not infringe third-party rights.

9. AI Disclaimers

  • AI outputs are not professional legal, financial, medical, or regulatory advice.
  • We make no guarantee of specific conversion rates or business outcomes.
  • You are responsible for reviewing and approving all content before publishing.
  • Generated content may occasionally contain inaccuracies — always verify facts.

10. Third-Party Services

The Platform integrates with Razorpay, Supabase, Google Gemini, Anthropic, OpenAI, and others. Your use of those services is subject to their terms. We are not responsible for their availability or conduct.

11. Limitation of Liability

To the maximum extent permitted by law, the Platform is provided "as is". Our total liability for any claim shall not exceed the greater of the fees you paid us in the 3 months preceding the claim or ₹1,000 INR. We are not liable for indirect, incidental, or consequential damages.

12. Indemnification

You agree to indemnify Fabeminds Counselling Private Limited and its officers, employees, and agents from any claim arising from your use of the Platform, your violation of these Terms, or your violation of third-party rights.

13. Privacy

Your use is also governed by our Privacy Policy, incorporated herein by reference.

14. Termination

Either party may terminate at any time. We may suspend or terminate access immediately for breaches. On termination, your access ceases and unused credits are forfeited (subject to Refund Policy).

15. Governing Law & Disputes

These Terms are governed by Indian law. Disputes are subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra, India. Both parties will attempt good-faith resolution for 30 days before initiating proceedings.

16. Changes to These Terms

We may update these Terms with at least 14 days' notice of material changes. Continued use after the effective date constitutes acceptance.
